Voting for Tyranny

In the first debate between Hillary Clinton and Donald Trump one thing became clear- neither is right for occupying the White House. How can either be the right choice when both oppose the Constitution? How can they take the oath to office without the Bible bursting into flames?

Hillary made a remark supporting the idea that people on no fly lists should not be able to purchase a gun. She attacked and repudiated the 2nd Amendment and the 5th Amendment to our Constitution with that simple statement. Then Trump agreed with her.

Understand what is at stake. They both agree that a secret list compiled by someone in government is enough to eliminate your right to keep and bear arms. We have this ideal in America that due process is important. That to circumscribe someone’s rights there is a process in place that must be followed to insure that our rights are protected. The 5th Amendment covers this explicitly.

“No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.”

How can the government legally determine that a person’s rights are negated without due process? It is the law of the land! How can they ignore that?

The government was NEVER tasked with determining if someone is guilty of a crime. That is why we have juries. Article 2 of the Constitution, the 5th, 6th and 7th Amendments all describe rights which we as Americans have that the government cannot ignore or infringe upon. A trial by jury is an inherent right under Common law and our Constitution. It is very simple. Government was never trusted to convict a citizen. That right was reserved for fellow Americans.

The 2nd Amendment is equally as clear. It states that the right to keep and bear arms shall not be infringed. It doesn’t give us that right. Our rights come from our creator and our government was instituted to protect our rights. It merely states one of our inalienable rights which the government cannot infringe.

I don’t know about you but to me the Bill of Rights is very important. Taking a position against anything contained in them is a deal breaker. If you feel the need to vote for Trump or Clinton, realize that you vote against the 2nd Amendment. You also encourage and support the ever increasing police state in which we live. This is not the path toward liberty. It is the status quo which is an ever increasingly large government whose unconstitutional interference into our daily lives escalates everyday. Say no to this insanity. Do not vote for either of these two charlatans. You nation depends on you to make the right decision.

Constitutional Cappuccino- The 2016 Elections Part 1

Here is my latest podcast. I discuss the 2016 election process from a constitutional view. I talk about the continuing fear campaigns being waged by Trump and Clinton and how emerging parties like the Libertarians and the Constitution Party are important to the long term viability of our republic.

Cruz Brilliance

Tonight Cruz gave his speech in front of the Republican National Convention. It went very well with some moderate to spirited applause until the end. Then he had the gall to say that he advises everyone to vote for a candidate that supporter freedom or the Constitution. He got booed as he walked off the stage after making that remark. I guarantee you that Cruz’ defense will be that it is too bad that so many Trump supporters don’t think Trump supports either freedom or the Constitution. Otherwise, how could they say that Cruz didn’t endorse Trump? This was brilliant on Cruz’ part. I think it will play out well. Their will be criticism and laughter about the criticism.

Constitutional Cappuccino Podcast- The Conservative Vision

This is podcast 5 from Constitutional Cappuccino. Take a look at past mistakes, add some common sense reform, mix n some SCOTUS wisdom and you have the essence of this podcast. It starts off a bit slow but when it hits its stride some great information and thoughts are given. Enjoy.

The Race to the Bottom- The 2016 Presidential Election

What we are seeing is a race to the bottom in the 2016 presidential election. All sides are using fear of their opponents to motivate people to vote for them. I have previously written about this and the theory is standing the test of time.

There is a reason for this. None of the candidates- Donald Trump, Hillary Clinton, nor Harry Brown are the best nor brightest of their parties. Just the opposite is the case. What we will see is a continuing program of smearing the candidates because there is little to say in actual support of these nominees.

Donald Trump. He is a serial liar. That is easy to prove. He was a self proclaimed New York liberal for the majority of his life and suddenly saw the light and became a Republican. He has no record to run on that supports his current stances. Sure, he SAYS some good things but contradictions can be found on all of his positions- illegal immigration and the wall, taxes, the 2nd Amendment, support for Hillary, Obamacare and single payer health care. The list is extensive. He cannot be trusted by anyone who does even a modicum of research. What is becoming apparent and will really be expanded on is his shady past. He has to win the nomination before the torrent is turned on,  but after that the 100’s of reporters doing their work will report on his history. His previous life will be laid bare and it will not be a pretty picture. Remember, all the media has to do is paint a picture that this greedy capitalist homophobic racist warmonger will destroy the country. They have only to make Bernie  and Hillary supporters believe that. That is the winning path for Hillary.

Hillary Clinton. 40+ years of lying and corruption surround her. There are people voting who weren’t even conceived while Hillary was perfecting her craft of lying and corruption. From her initial participation in the Watergate investigation in the early 70’s and subsequent expulsion for unethical behavior to her most recent dodging of an indictment in her handling of sensitive materials on an unsecured e-mail server- her record as an elected official and public servant is abysmal. She has accomplished nothing of significance in her time in office. She sponsored some inconsequential legislation as a Senator in New York and had a horrible record in the State Department. Her involvement in Benghazi and the deaths there, 6 Billion dollars missing, the sale of Uranium to Russia, the Iran Nuke Deal, and her support of the Arab “Spring” which have all had horrible repercussions. She also has little to give supporters as a reason to support her. Sure she is a woman. So was Lizzy Borden. So was Typhoid Mary.

Harry Brown. He is the best in the crowd and does have some actual success in an executive position as Governor of New Mexico. Yet he too has slipped into the “A vote for Johnson is a vote against Hillary and Trump. How can it get any better?” He is not a good example of a Libertarian. The principled supporter finds it hard to support him in some of his positions. His stance on government intrusion into business affairs is astounding to see. He stated that the intentions of a baker in withholding their services matters to as whether the government comes in and forces the baking of the cake. I cannot believe a Libertarian said that. He calls for the force of government being used to make a baker bake a cake under certain politically correct circumstances. Pretty disturbing to the principled libertarian. His stance on immigration is NOT the mainstream view in the Libertarian Party. That is the Libertopian stance that is a minority with a loud voice that is being amplified by the media. One thing the media downplays or simply does not report on is the elimination of all government subsidies to immigrants in most of these “open border” scenarios. Lastly, his recent support of Hillary concerning her e-mail scandal made no sense. Listen to his comments on the matter. He doesn’t want to be a ‘stone thrower” and thinks it wasn’t her “intent” to commit a crime. Johnson has some good ideas on limiting government and instead of espousing in explicit terms what needs to be done he descends into the media dialogue and the story they want to tell. He gives little for the principled conservative or libertarian to support.

Bottom line: What we are going to continue to see is a tearing down of the candidates by their opponents and little for supporters to actually support. These attacks will continue with the opponents painted to look like a nation threatening despot. In the case of Johnson, the idea of a wasted vote or the idea that voting for him is actually a vote for Hillary/Trump will be pushed.. Just more fear tactics. This fear will be supported on all sides by the continuous castigation of the candidates. Please realize that fear of an opponent is not a reason to vote for a candidate. You are not voting FOR someone, you are voting AGAINST someone else. That is why we are at the crossroads we are. Support someone. If you cannot find someone to support then write in someone. Your vote is only wasted if you don’t vote your conscience.

The Sheriff:The First Line in Defense of Liberty

I know that with election time coming up many races are filling the screen of your TV and computer. The Presidential election coming up looks to be one of the more interesting in recent times. But I am here to tell you why I believe that one race that a lot of people overlook is the most important to get involved in- Sheriff of your county.

The history of the Sheriff is many centuries old. The first written record of the Sheriff dates back to the reign of King Alfred in the 9th century. The King restructured the kingdom into “shires” and appointed “reeves” to administer his will on his subjects. These shire reeves eventually became to be known as the Sheriff.

It is interesting to note that when King John of England was forced to sign the Magna Carta in 1215, the document which introduced many concepts that were incorporated into the United States Constitution over 500 years later, that the “Sheriff” is mentioned 27 times (out of 63 clauses) in the document, and the powers of the crown to use him against the people was curtailed and defined.

When the idea of the Sheriff was brought to our shores in America, it was a lot closer to today’s idea of the Sheriff. Gone was the allegiance to the power of the state (or monarchy) but instead the allegiance was to the people who elected them. Thomas Jefferson described a Sheriff as ” the most important executive offices of the country”. High praise from a respected man.

The Sheriff in no uncertain terms is the highest law enforcement authority in his/her county. The Sheriff is elected by the people and charged to uphold and defend the Constitution of the United States and that of their own state. That is their duty and they are responsible directly to the people to perform that duty. The are the law of the county.

The Sheriff’s responsibility is to protect the constitutional rights of its citizens from wherever that encroachment occurs. Most people rightly attribute crime fighting to the Sheriff. That is a major responsibility. But the Sheriff’s responsibility does not end there. If ever a citizen of a county has their constitutional rights violated by any representative of the government, the first line of defense to this intrusion if the Sheriff. If an arrest is to be made in a county, the Sheriff has the right to be informed before the arrest is made in his/her county. The Sheriff should determine that the arrest is proper, and was properly adjudicated through the courts. Our federal government is having a much higher tendency to skip due process and render judgements which are unconstitutional.

In New Mexico, Sheriff Scott London of Eddy County notified the IRS that the sale of county resident Kent Carter’s property was canceled until he received due process of law and his appeal was heard. Yes, he successfully told the IRS “no”! Sheriff Richard Mack of  Graham County Arizona was instrumental in the ruling Printz vs. United States in which parts of the Brady Bill were ruled unconstitutional. In Indiana, a farmer who produced raw milk was harassed by the FDA. They conducted warrantless searches of his property and even subpoenaed him to produce production records until Sheriff Brad Rogers interposed after inspecting the farm. He wrote the FDA a letter that stated they needed a signed court order and to get his permission before they visited the farm again. After that, a court date was cancelled and the farmer received no more inspections by the FDA. These are just a few cases that the Sheriff was involved in upholding their constituent’s rights.

Looking to the future some in Congress, the judiciary and even in the executive branch would like to get their hands on your guns or curtail your ability to carry them as seen recently in the 9th Circuit judgement that ruled concealed carry is not a constitutional right. A constitutional Sheriff would NOT allow this blatant violation of our right to keep and bear arms. That is within their power. Another flagrant violation of our rights are gun free zones. These criminal hunting grounds are unconstitutional and need to be eliminated. A constitutional Sheriff would simply ignore anyone who was caught exercising their right to carry in those zones and refuse to prosecute. The Sheriff cannot change laws, but they can protect the rights of their citizens from any encroachment from unconstitutional laws in their county. Think of recent actions by the BLM, FDA, IRS and EPA and what they could do to you if you appear on their radar.

We are lucky here in Orange County Florida for we have such a candidate running for office. His name is Spike Hopkins. He has had a long career as a law enforcement officer and has some great plans to make the Orange County Sheriff’s department more effective once again. He is well respected by his co-workers and others I have talked to. He is a congenial man yet is serious about the work of the Sheriff’s office. More importantly, he is a man who would take his constitutional oath seriously and protect the rights of Orange County citizens from encroachment. He is a member of the CSPOA (Constitutional Sheriff and Police Officers of America)  and Spike is a strong supporter of the 2nd Amendment. He has made the pledge to me personally that he would never confiscate guns nor allow it to happen in his county. For those of you who say this could never happen then his actions will not be needed. For the rest of us living in reality having this protection would give each of us a confidence knowing that the Sheriff has our backs when it comes to the 2nd Amendment.

I urge you to take a look and support Spike Hopkins. A person who supports the Constitution is a very good thing these days. When they are qualified and do run for Sheriff, they need our support, money and vote. A good man who the residents of Orange County deserve as their next Sheriff is Spike Hopkins.

Join me at Constitutional Cappuccino to get plugged into a website that is all about the education Americans need to move our country back to its proper trajectory. My new book “Patriot Ammo: The Words Behind Our Flag” is also available and teaches of our founding documents and principles. The book would make a great present for anybody 16 and up.

Thank-You Ted Cruz

I was drafting an article asking Ted  Cruz to consider dropping out, but he beat me to the punch. Kudos to you sir. You have made a wise and great long-term decision. It was the right and upstanding thing to do.

I was going to point out that even if there was a contested convention and Cruz had the numbers to take the nomination in the 4th or 5th round, the resulting tumult would be horrendous. No matter how a contested or a brokered convention played out, Cruz would have been the scapegoat for any ills experienced by Trump later on if he lost or would have too much bad will to win the general election himself. Cruz’ decision to drop out after a loss in Indiana is huge for his long term success.

I was going to point out that dropping out early enough so Trump could get the 1237 number would absolve Cruz of any culpability concerning establishment tricks during the convention. This, in my opinion, was crucial to the long term viability of Cruz as a presidential candidate. The establishment has been coming to the Cruz camp as of late and it is nice to see that he would rather abandon his run then get cozy with them.

I was going to further point out that Ted Cruz has a job in Texas for as long as he wants. His support has only grown since he made this run.  Cruz has run a fine race against the odds and did very well. 2020 will be a great year for conservatism and the Constitution. Four more years of people actually seeing Cruz in action on the Senate floor will consolidate many who were doubters.  Getting out now also avoids any ambiguity as to his involvement in a Trump loss.

And this brings me to the Dark Side of the equation. The inevitable Trump loss. A Hillary presidency is virtually guaranteed at this point.  If she can dodge indictment and actually close the deal against Sanders (which mathematically seems inevitable) there will be another Clinton in the White House. Trumpsters were warned. Hillary has a base of supporters who do not care that she is a liar and political hack. They do not care about her long list of scandals and lack of accomplishments. She is a democrat, she is a woman, she is their pick. End of story.

Unfortunately for Trump the republican side does have some principled people. They do care about their candidate’s character. Many will not vote for Trump. They are done with the lesser of two evils. At best Trump is another big government progressive. At worst he is there to give Hillary the nomination. Either way he will get only lukewarm support from the conservative base which will mean a huge loss for him. HUGE!

The hit pieces against Trump will start slowly but ramp up in intensity and frequency as we get closer to election time. People will be brought forward who have personal stories of how Trump and his actions harmed them. The democratic support Trump has been enjoying will evaporate as he is attacked. Not that some of them were true Trump supporters anyway. Many were just there to support the weakest of the republican candidates to get their candidate Hillary into office. They did some fine work.

Bottom line: it is past time that Americans understood the Constitution and how it has been perverted. I supported Ted Cruz because he supported my ideals- a limited constitutional government. We could have done it the easier way with a Cruz presidency. We have chosen to do it the hard way. It is time that people realize that government are formed among men to protect their rights, and that government gets their power from the consent of the governed. It is time people realize how outside of the constitutional box Washington DC has forayed and demand changes. Their is ONE reason that this country has been as prosperous and free as it has- it is called the Constitution and Bill of Rights. As we move away from those ideals we see the results.

Washington is not going to voluntarily give up its power. President’s do NOT make law. The Supreme Court issues OPINIONS, not law. The ONLY body allowed to make law is Congress. And they have severe restrictions as to what they can deal with. The administrative bureaucracy we have created where legislative, executive and judicial power is vested in individual organizations needs to be dismantled. A separation of powers must be adhered to. States rights and a proper relationship between the federal and state governments needs to be re-established. This is on the People of the United States of America. It is time we hold our officials feet to the fire and demand constitutional accountability. Washington is not going to fix itself. It will take local and state officials, working in their official capacities to protect the rights of the citizens of their states from Washington, DC, to make the changes needed to continue this country’s unparalleled ascent into freedom and prosperity. God bless America.

A Time for Conservatives to Unite

With Super Tuesday behind us it is time to face reality. tRump must be stopped. He is no conservative and his presence in the Republican nomination process allows a Hillary victory. It is time for conservatives to unite.

It is now apparent that Ted Cruz is the man to take tRump down and the one to beat Hillary. Rubio’s poor showing (congratulations on Minnesota though) in this election cycle shows he is consistently taking a back seat to Cruz with conservative voters. Cruz has shown he can stand toe to toe with tRump and win. Texas was a big win, but Oklahoma is even bigger by the fact it was the first closed primary state. When tRump cannot rely on democratic voters he is definitely put at a disadvantage.

Rubio has some problems of his own. Florida is around the corner and if he loses to tRump there it could seriously damage his future chances at office. It would definitely harm any future campaign he was looking to enter. Rubio is the last of the establishment’s candidates and even with their backing he is not competitive.

There have been indications that the GOP establishment is biting the bullet and may get behind a Cruz candidacy. Lindsey Graham came out after his now infamous “no help from Senate after Cruz is shot on the Senate floor” remarks and lamenting the fact it may be time to unite behind Ted Cruz to take out tRump. Other indications show that the anti-Cruz establishment stance is softening out of desperation over a tRump candidacy.

This brings me to the point of this article. Cruz must ask Rubio to be his nominee for 2016. Right now if that was done it would cement the anti-tRumpers into one coalition. Carson and Kasich would see the writing on the wall and either have to support tRump or be forced out of their campaigns. Cruz/Rubio would take the tRump campaign to task and they would be the Republican team for 2016.

If Cruz and Rubio act quickly enough, they could win Florida for their efforts. This would really put a crimp in the tRump machinery and more importantly for Rubio preserve his image for future political office. This would be a win-win situation for Cruz and Rubio on all fronts.

Some will say that this will be impossible due to the differences of the candidates. Poppycock is my response. Look to 1980. Reagan picked George Bush who is the one who created the term “voodoo economics” to describe Reagan’s economic policies. They ended up with a successful run together and Bush benefited with becoming President afterwards. Rubio is still young. He has plenty of time for future runs. This would look good on his resume.

Looking back to the founding of our country we witness James Madison firmly on the side of the federalists early on. Through his association with Jefferson however, he soon became a major force in the anti-federalist camp. He had argued against a Bill of Rights during the constitutional convention yet was the one who proposed during the first Congress that a Bill of Rights was necessary. This was due to Jefferson’s influence with Madison. I see something like that happening if Cruz and Rubio team up. Rubio seems to be a smart man who knows the Constitution but has kept some bad company. A little guidance and working with a consistent constitutional conservative will help him for the rest of his years.

I do not know if this is just tilting at windmills but to me it seems like solid logic. Everyone who has a potential to be a winner in this deal has it under their control to make this happen. This allows conservatism to prosper and we can bring the Constitution back to the White House and move toward prosperity again.

Cruz/Rubio 2016. Bring the Constitution back to the White House.cruzrubio2016
