Nullification: A True Liberty Activity

Libertarians in Florida (and in general) need to start addressing issues that are relevant today instead of spouting off about fantasy “solutions”. Talking today about anarchy or open borders does not resonate nor is it a true path toward liberty. Both ideas represent a refusal to deal with real world problems. Neither is a solution to what faces America.

One of the topics we should be talking about is fighting unconstitutional federal laws that affect us in the state of Florida (or any other state you may reside in). This is a problem of “right now” and needs to be solved. Fortunately for us we don’t have to reinvent the wheel. This idea has already been thought about and a solution has been formulated. This is an enumerated principle of Libertarians here in Florida and is a very powerful tool to counter unconstitutional edicts, mandates or “laws” issuing from Washington DC. The process is a simple one to understand and extremely effective in its execution. The simplicity of it is what makes it so elegant.

It is called nullification. It is the idea that a state decides that the federal government is operating outside of it constitutional bounds and is infringing on the rights of its citizens. Its action is to declare the law unconstitutional, the reasons for determining this and stating that no one who works for the state or within the state may aid or in any way help this unlawful expression of power originating from Washington DC. It is an idea espoused by Thomas Jefferson and James Madison. It is the constitutionally tried and true method to fight unconstitutional tyranny issuing from Washington DC.

Before you scoff and say this can never happen realize it has happened multiple times throughout our history and is currently being revived throughout our United States. Look to Washington and Colorado. How long ago did they nullify unconstitutional federal marijuana laws and say the law shall not be enforced within their state limits? Realize, neither stated that they wanted to nor have they tried to change the federal law. What they have done is affirmed that the federal “law” is unconstitutional and not to be enforced within their borders. State agencies and law enforcement are disallowed in aiding or initiating any actions against those people who grow or sell marijuana. The state is to do NOTHING!!! How Libertarian is THAT?! You fight no one. You see unlawful aggression and say that you will not support nor participate in the activity. Without the manpower and logistic support it is almost impossible for the feds to do anything within a state. This is the power of doing nothing.

Another current trend that is not being reported or being under-reported is the “Right to Try” laws. Thirty one states to date have passed laws nullifying unconstitutional mandates of the FDA concerning human “experimentation”.  These laws allow terminally ill patients to purchase drugs that are not currently approved by the FDA. Imagine that? People who are dying have a chance to save their lives in opposition to unconstitutional laws coming out of Washington DC. Imagine also why this is not widely reported on? Imagine if the people figured out they could actually make decisions for them selves and not rely on Washington DC? Things could change for the better and some in charge would not like that.

Other additions to the modern day nullification movement involve constitutional carry. Twelve states where there is no requirements for people to obtain any type of license to carry a gun. Some states and municipalities have nullified ALPR’s (Automatic License Plate Readers) within their bounds of their jurisdictions. This interposition is of varying degrees of restrictions on their collections. Many states have taken up or passed legislation restricting the monitoring and collection of cell phone data within their states via Stingray technology.

I leave hemp for last because it is a special topic for Floridians. Six states have nullified unconstitutional federal laws in their states and now grow hemp legally. Hemp is a wonder crop that has a multitude of uses and is a great crop to rotate to replenish soil. For those who are concerned about misuse, the THC content of hemp is negligible. The use of it as a drug would not be viable. But it IS very useful for many things and is the stuff that prosperity is built upon. Growing a plant that can make rope, canvas, food, drinks, paper, fabric, clothing, building supplies ( including hemp blocks to build houses), and plastics only makes sense. Hemp is the top plant for producing the most cellulose biomass per acre which makes farmers the most money per acre. This biomass is what paper, plastics and textiles are made of. No chemicals or insecticides are needed . All of this from growing this prolific and easy to grow crop. It is not legal in Florida but the industry would thrive here in the state. Because of our weather hemp could be grown year around and be among if not define the highest cultivation rates in the United States. The industries that would be created around this production would create real business and prosperity for Floridians.  We don’t do this because the federal government says it is illegal and the people in Tallahassee have big donor support who like things the way they are. They do not want to fight. That’s where Libertarians get involved.

So you see that nullification is trending and is definitely a force for liberty. Recognize this is a universal principle that will attract many people. . Republicans, Democrats, Independents, Libertarians, Constitutionalists all would agree that determining our own path is a good thing. We will not agree once we have the power what we want to do but at least we the people of Florida decide how we want to live. That is how our country is supposed to work. Washington DC was never supposed to be tinkering with the inner workings of a state. Their focus was to be a representative of the states for the rest of the world and to make sure the states played fair with each other. The primary function of our Federal Government is to secure our rights. Patents and trademarks, weights and measures, coining money, Post offices, postal roads, raising a Navy and Army, conducting war, protecting us from invasion and guaranteeing a republican form of government round out the majority of their enumerated tasks . The rest was left up to the states and the people. Article 1 Section 8 of the Constitution describes exactly Congress’ tasks. How far away from this ideal have we wandered? That is what we fight today to realize liberty tomorrow.

It is my hope that Libertarians can coalesce and figure out as a group how to present their message to the public so we can be a viable force for liberty. The portrayal of libertarians to date has been abysmal and it is up to us to change that. The powers that be like the status quo- i.e. republicans and democrats being the only viable options. Getting behind and promoting an idea such as nullification is a short term and long term winner for libertarians. The true beauty is it is already part of our principles here in Florida. All we need are representatives and candidates who will espouse this policy. Time to get busy.

2016 Elections: The Silver Lining

What if I told you that the 2016 elections could go down as a seminal moment in our country? That this election could be recorded  in the history books as a turning point in modern day American politics? It is my contention that if more people were true to themselves and voted their conscience then some good could come out of this election cycle. We the people can start to turn the needle back toward the path of liberty and prosperity. Some have realized this path but many deny the truth before their very eyes.

The two party monopoly we witness in this country is the largest impediment we face as a nation. Breaking this monopoly is one of the ways to stop the lawlessness we have witnessed issuing from Washington DC (District of Corruption). The democrats and republicans are very much like Coke and Pepsi. They are self avowed “competitors”. They offer different products that are almost the same with just a little difference of taste and packaging.  They may “oppose” each other but each supports the other so they both can remain on top. Look at supermarket soft drink rotation and placement. Neither wants to eliminate the other because they both recognize that they can prosper and continue to prosper by eliminating unvetted competition and keeping both their products prominent. A new major player could upset the balance. The same theory is applicable to the republicans and democrats.

This is what we have been witnessing in our national politics.

Democrats have moved so far toward socialism that describing them as liberals is disingenuous. Limited constitutional government? Pelosi would burst into flames if she was made to utter these words. Democrats have aligned themselves with Alinsky and Marx. They follow a playbook that has been described to us over a century ago. It includes racial division, economic division, gun control, creating debt, creating government dependence, control of education, attacks on religion, and controlling healthcare. Sounds like they have been busy and pretty successful. This plan has been implemented for over a century now and we are seeing the endgame emerge. The big problem is no one politically is opposing these unconstitutional changes.

It is my contention that the republicans are the water carriers for the democrats these days. They have capitulated and supported leftist policy openly and brazenly as of late. Obamacare. Sanctuary cities. Common Core. The budget. We get promises. We hear excuses. Society continues to move away from prosperity and freedom and move toward poverty and dependence.

Why do we still have Obamacare? The latest news is very damning. Some people’s premiums are going to go up over 100%. Most are expected to rise by at least 20%. This is anything but “Affordable”. The republicans have had control of the House for 5 years now and could have defunded it at any time. It would have been a political fight but they have every constitutional right to present any budget they want. Understand what the power of the purse is. Any previous bill passed by Congress that becomes law is susceptible to future Congresses. If the present Congress does not fund something, then it disappears. It is that simple. It is that powerful. Now there is always political fallout but this defunding is easily accomplished. The reason that we still have Obamacare is because republicans like it. It is an easy way to “differentiate” themselves from democrats. Their lack of action shows their lack of integrity and what I suggest- their collusion with democrats.

Ask yourself how did we double the national debt when we had a republican Congress for the last 5 budgets? Along those same lines why did republicans pass a continuing resolution this year which ends after the elections and is subject to a lame duck session of Congress to handle? A logical reason would be to take the responsibility for passing a budget off of the current Congress so neither side can be criticized for their decisions. A December vote can be manipulated so both sides can claim victor, not that anyone pays attention to politics right before Christmas. Especially after an election year such as we have seen.

Along the same lines as above, why do we still have an illegal immigration problem and why are sanctuary cities still getting federal funding? Why is common Core still funded and the Department of Education still in existence? Is that collusion I smell or has a donkey and elephant been murdered, left to rot and replaced with a rat and a tapeworm? Neither party at this point even pretends to uphold and support the Constitution. Their oath to office is a mere formality to pick up a check. Americans used to care. Real Americans still do.

Democrats have splits among many in their base. It seems that Hillary’s corruption in this primary season, the constant unfurling of revelations about her attitudes towards many of her voting demographics and the support by the highest levels of the democratic party to fix the primary has further aggravated those divisions.  The constant anti-gun, anti-Constitution, and pro big government stance the democrats have adopted has led many  good, true liberals to question their support of the democratic party.  The revelations being exposed by wikileaks when it comes to Hillary and her circle of corruption is not helping democrats either. These revelations may not swing the election, but if she is elected they will be like a little sprout that will grow into a large redwood that will be used as fuel to make her presidency even less effective than her history in public office would suggest. Scandal will follow her like stink a skunk. And rightfully so. Hillary is the most corrupt person to ever run for the office of the presidency.

The republicans have had problems for a while as they have turned their backs on the Constitution and conservatives. Boehner and McConnell were the epitome of what conservatives considered wrong with the party. Eric Cantor, majority leader was primaried. Boehner resigned but not before passing a very pro-Obama budget. Now we have the Ryan paradigm. He is no better that what was in place previously. Republicans elected a republican House and Senate in 2014 in a landmark election yet STILL nothing significant was addressed. Then came the Trump fiasco.

Trump has come out against the Constitution on many occasions. In the first debate Trump agreed with Hillary that people on a no fly list should not be able to purchase guns. That is against the 2nd and 5th Amendments. Trump has repeatedly said that state boundaries are “imaginary lines” when talking about healthcare. That is against the very fabric of the Constitution and its status as a compact. Speaking of Healthcare, Donald has stated his opposition to Obamacare but not because it is unconstitutional. He wants a true government run single payer healthcare system. Go to youtube and you too can see where in a 60 Minutes interview Donald says “The governments going to pay for it but we are going to save so much money on the other side” Trump only opposes Obamacare because it didn’t go far enough. Trump is another in a long line of big government progressives who thinks if he is in control then he can make government work for the people. He has no interest in abiding by his oath to office. No real American can vote for him either.

So now the silver lining part.

Breaking the two party monopoly we are witnessing is one of the most effective ways to get our government under control again. The monopoly must be broken for our republic to survive. Donald Trump and Hillary are the exclamations points to that statement. They exemplify what happens as we continue to vote for the lesser of two evils. But there are other choices. Do not let fear or charlatans tell you anything else.

Darrell Castle of the Constitution Party is a viable choice. The Party’s stance is simple- -uphold and defend the Constitution. They have a solid constitutional base for their beliefs. Any American who support their party can sleep well at night knowing the vote they cast was righteous and moving America in the direction of freedom and independence once again.

The Libertarians are also a viable choice. Yes, I understand that Gary Johnson is not a good candidate and definitely not a good representative of the Libertarian Party. If you were to look into the principles of the Libertarians, you would find a deeply rooted belief in the Constitution espousing principles written about and supported by men like Thomas Jefferson and James Madison. It is my belief that Gary is there to sabotage the Libertarian movement this election by doing exactly what he is doing. It is not some great conspiracy. It is just Gary. He is not a Libertarian yet he got the nomination because of his popularity and celebrity among the libertarian elite. A true libertarian who understands and can articulate the non-aggression principle that the Libertarian Party is built upon would be enjoying phenomenal success this cycle. Unfortunately, we have Gary instead.

There is one more person I wish to speak about. Evan McMullin. Do not be fooled by his slick performance. Evan is an establishment shill. His stated purpose is to throw the election to the House of Representatives. Last time I checked the House of Representatives was populated by republicans and democrats. How is he anybody but a person supporting the status quo, namely the republican and democrat monopoly? He represents no party. He promotes no one but himself which means any support he garners cannot carry past the man who started it. His true purpose is to blunt the rightful third party response this election cycle. Do not be fooled and do not be a fool.

Bottom line: The problems we face as a nation are over a century in the making. Their origins can be traced to Theodore Roosevelt and his successor Woodrow Wilson. Problems of this magnitude are not solved in a single election. They are probably not solved in a generation. The unlawful actions of our federal government must be stopped. Law must restored. Forget the idea that Washington DC is going to fix itself. That will not happen until their unsanctioned and unlawful implementation of power is reversed. That is for another article. Just realize that a vote for a third party this year is a vote to start making life better here in the United States. A vote for Castle or Johnson is a move back toward liberty and prosperity. Do not let fear of a candidate make you vote for someone just to oppose another. If you cannot support someone just don’t vote for anyone in that race.That is a much more honorable use of the vote than to support the lesser of two evils. It is time for Americans to be Americans. The ” land of the free and home of the brave” used to be more than just the ending to a song. Stand up for the Constitution. Stand up for America.

Constitutional Cappuccino- The 2016 Elections Part 1

Here is my latest podcast. I discuss the 2016 election process from a constitutional view. I talk about the continuing fear campaigns being waged by Trump and Clinton and how emerging parties like the Libertarians and the Constitution Party are important to the long term viability of our republic.

The Race to the Bottom- The 2016 Presidential Election

What we are seeing is a race to the bottom in the 2016 presidential election. All sides are using fear of their opponents to motivate people to vote for them. I have previously written about this and the theory is standing the test of time.

There is a reason for this. None of the candidates- Donald Trump, Hillary Clinton, nor Harry Brown are the best nor brightest of their parties. Just the opposite is the case. What we will see is a continuing program of smearing the candidates because there is little to say in actual support of these nominees.

Donald Trump. He is a serial liar. That is easy to prove. He was a self proclaimed New York liberal for the majority of his life and suddenly saw the light and became a Republican. He has no record to run on that supports his current stances. Sure, he SAYS some good things but contradictions can be found on all of his positions- illegal immigration and the wall, taxes, the 2nd Amendment, support for Hillary, Obamacare and single payer health care. The list is extensive. He cannot be trusted by anyone who does even a modicum of research. What is becoming apparent and will really be expanded on is his shady past. He has to win the nomination before the torrent is turned on,  but after that the 100’s of reporters doing their work will report on his history. His previous life will be laid bare and it will not be a pretty picture. Remember, all the media has to do is paint a picture that this greedy capitalist homophobic racist warmonger will destroy the country. They have only to make Bernie  and Hillary supporters believe that. That is the winning path for Hillary.

Hillary Clinton. 40+ years of lying and corruption surround her. There are people voting who weren’t even conceived while Hillary was perfecting her craft of lying and corruption. From her initial participation in the Watergate investigation in the early 70’s and subsequent expulsion for unethical behavior to her most recent dodging of an indictment in her handling of sensitive materials on an unsecured e-mail server- her record as an elected official and public servant is abysmal. She has accomplished nothing of significance in her time in office. She sponsored some inconsequential legislation as a Senator in New York and had a horrible record in the State Department. Her involvement in Benghazi and the deaths there, 6 Billion dollars missing, the sale of Uranium to Russia, the Iran Nuke Deal, and her support of the Arab “Spring” which have all had horrible repercussions. She also has little to give supporters as a reason to support her. Sure she is a woman. So was Lizzy Borden. So was Typhoid Mary.

Harry Brown. He is the best in the crowd and does have some actual success in an executive position as Governor of New Mexico. Yet he too has slipped into the “A vote for Johnson is a vote against Hillary and Trump. How can it get any better?” He is not a good example of a Libertarian. The principled supporter finds it hard to support him in some of his positions. His stance on government intrusion into business affairs is astounding to see. He stated that the intentions of a baker in withholding their services matters to as whether the government comes in and forces the baking of the cake. I cannot believe a Libertarian said that. He calls for the force of government being used to make a baker bake a cake under certain politically correct circumstances. Pretty disturbing to the principled libertarian. His stance on immigration is NOT the mainstream view in the Libertarian Party. That is the Libertopian stance that is a minority with a loud voice that is being amplified by the media. One thing the media downplays or simply does not report on is the elimination of all government subsidies to immigrants in most of these “open border” scenarios. Lastly, his recent support of Hillary concerning her e-mail scandal made no sense. Listen to his comments on the matter. He doesn’t want to be a ‘stone thrower” and thinks it wasn’t her “intent” to commit a crime. Johnson has some good ideas on limiting government and instead of espousing in explicit terms what needs to be done he descends into the media dialogue and the story they want to tell. He gives little for the principled conservative or libertarian to support.

Bottom line: What we are going to continue to see is a tearing down of the candidates by their opponents and little for supporters to actually support. These attacks will continue with the opponents painted to look like a nation threatening despot. In the case of Johnson, the idea of a wasted vote or the idea that voting for him is actually a vote for Hillary/Trump will be pushed.. Just more fear tactics. This fear will be supported on all sides by the continuous castigation of the candidates. Please realize that fear of an opponent is not a reason to vote for a candidate. You are not voting FOR someone, you are voting AGAINST someone else. That is why we are at the crossroads we are. Support someone. If you cannot find someone to support then write in someone. Your vote is only wasted if you don’t vote your conscience.
