Protected Classes: A Step Above and Superior to Unalienable Rights

I just heard the news concerning the verdict of the Oregon cake maker who refused to create a wedding cake for a lesbian couple. The verdict was for the couple and against the baker. No surprise to me. This is Oregon we are talking about after all. But that does not diminish my angst at the ruling. This decision is flawed on many levels but that again is nothing new the with modern day interpretation of jurisprudence. This is just another in a long line of attacks against the values and laws this country was founded upon and thrived under.

To think a person has a right to make someone else perform an activity is misguided. We have a word for that. Slavery. Or maybe indentured servitude since there is a payment. Either way, it takes away the person’s ability to control their own lives because of the will of another. Who owns your life? You, a stranger or maybe the courts or government? The true answer should be clear. Reality. however, is showing a different answer.

The most fundamental unalienable right a person possesses is the right to life. You and you alone are responsible for your own life. Your life is yours to live however you want as long as you infringe on no one else’s rights. The living of your life is what we refer to as liberty. When someone tries to introduce into that equation any type of coercion or force to make you do something you do not want to, then your most basic rights are being violated.

In this case, two lesbians went into a bakery shop, since closed by the way, and ordered a wedding cake, The owners of the bakery said they could not design a cake for such a purpose, but they were free to get anything else in the bakery. The bakers stated that a marriage performed for gays was not in accordance with their Christian beliefs and they would not use their talents to participate. The couple insisted on the wedding cake and were refused. They then left.

Instead of doing what a normal couple would do and find another baker to make the cake, they decided to sue. They complained to the Oregon Bureau of Labor and Industries saying they were refused a cake because of their sexual orientation. That bureau eventually slapped a $135,000 fine on the bakers and the bakers appealed. This latest decision is the results of that appeal.

Instead of telling their story and letting the public (consumers) decide the fate of the bakery, this couple instead choose to use the power of government to enforce their will. I cannot find it anywhere, but I am guessing they did indeed buy a cake from another bakery for their wedding which occurred. So a cake was had yet the lawsuit went forward because they couldn’t get a cake. They were offended because a specific baker denied the use of his services to make a cake. Being offended in today’s society seems to be a cash cow for those with special government protection.

Because they couldn’t get a cake from a specific baker, and because of the ensuing controversy, this couple claimed to have experienced an array of maladies. This is a partial list of the 88 symptoms they claimed to have suffered from because of the ordeal. An “acute loss of confidence”, “doubt”, and “uncertainty”. They claimed they “felt mentally raped, dirty and shameful”, had “high blood pressure”, “impaired digestion”, “weight gain” and “loss of appetite”. The said they suffered “excessive sleep”, “migraine headaches” and were “pale and sick at home after work”. One or both of them began a “resumption of smoking habit”. They also were fraught with “shock”, were “stunned”, “surprise”, and had “worry.” For that and other symptoms they received a total of $135,000.

“It does not matter how you were born or who you love. All of us are equal under the law and should be treated equally. Oregon will not allow a ‘Straight Couples Only’ sign to be hung in bakeries or other stores,” This is the couples idea of justice. The ideals of liberty are wiped away because of someone’s feelings or special protections. The idea that if someone doesn’t get their way, they then sue because they are being discriminated against because of who they are. And, oh yeah, only certain classes are protected in this ideal.

Realize the truth here – A “protected” class of people have superior rights above and beyond the unalienable rights that we regular humans possess. They are “special” because of their deviation from the rest of society. They get special “rights” because of their minority status. Because of this special privilege, they are superior in the eyes of the law. If you are not protected then no one in government really cares.

Another incident that occurred during this time period found the baker’s GoFundMe account closed because GoFundMe’s deemed that the bakers were wrong. Along these lines, what about the musicians who refused to perform for Trump’s inauguration? What about the dressmakers who publicly refused to design Melania Trump’s dresses? These ideas are parallel and hypocrisy is what separates them.

What also separates them is the people “offended” acted like adults, not spoiled kids and got their products somewhere else. Real Americans take this issue into their own hands and if offended enough start a boycott to make the business see reason. I cite Target and the NFL among the most recent. Chick Fil A also had this idea applied to it..

The idea that someone who is offended can invoke the bureaucracy to strike back at the people who offended them is malicious and dangerous. The idea that someone who doesn’t get to participate with a specific business for whatever reason can invoke the power of government without due process and get awarded money is a gross miscarriage of justice. No one has a right to tell another person how to use their life. It is true fascism to think government should be able to tell a business how to operate. But that is exactly where we are at. The same people that cheer Antifa also support fascism.  How is that for hypocrisy? Whatever happened to the leftist mantra of “pro-choice”?

This is a very slippery slope we have engaged upon. it is my hope that the Supreme Court rules on the very similar case it now has before it, Masterpiece Cakeshop v. Colorado Civil Rights Commission, correctly. Whatever the courts do or don’t say, it is time for we the people to have our voices heard.

Bureaucracies ruining a family business and courts telling us what the law is and how to act need to be opposed. The “snowflake” mentality of injury because of perceived persecution needs to be fought. When we allow the courts and bureaucracy to dictate how our lives are to be lived then we are no longer free and are being ruled by an oligarchy. Our constitutional republic must be preserved and fought for. Liberty must triumph. Patriots Awake!

Political Correctness, Idiocy and the Attacks on Our republic

The attack on western institutions, traditions and values continues in this country unabated. These attacks are perpetuated by those traitors in our midst who, through the support of a sympathetic media and useful idiots (usually simply ignorant people) in our society, are looking to institute a socialist society here in the United States of America. The transformation is well on its way and continues under the cover of political correctness and just plain stupidity. Socialism is an enemy to freedom, liberty, and prosperity. History has proven that beyond a shadow of a doubt. On the other hand, a limited government instituted exclusively to protect the rights of the people has to been shown as the best way forward to freedom and prosperity. Political correctness, idiocy and a program of indoctrination is the culprit of our ongoing demise.

Let’s begin with the attacks on white “supremacists”. Supposedly hate is bad yet these are people you are allowed to hate. It is ok to hate these people because we are told they are evil. It is politically correct to hate these people because we are told to do so by the media and some of our leaders. We are allowed to espouse and perform violence against these people because of what they supposedly think. How are the thoughts of some people, devoid of any action, infringing on your rights? How does what a person believes injure anyone? It does not. It is political correctness devoid of any reason that is the culprit. It is a campaign to silence anyone who questions the orthodoxy of the left.

More people continue to wake up to this fact. As the insane attacks continue on those people who speak out against the socialist forces attacking our republic, more people are questioning the doctrines of the enemies of America. We used to believe in free speech and freedom of assembly. Now, some in our society have a higher calling – political correctness. This is how republics are destroyed. This is how rights are eliminated and tyranny triumphs.

Robert Lee is an announcer for ESPN who was pulled off the University of Virginia’s game due solely to his name. In a surrender to political correctness, ESPN has taken this step to avoid offending anyone who will be watching the game. An ESPN spokesperson justified the removal of Lee from the announcers spot because ESPN executives “collectively made the decision with Robert to switch games as the tragic events in Charlottesville were unfolding.” More political correctness at work. Again, more pandering to the lowest common denominators of society and those that perpetuate the redefining of America.

Speaking of Charlottesville, it has become known that the attacks on those who were opposing the removal of the Lee statue were perpetuated by government forces who were opposed to the rally in the first place. Did you know that the protestors were denied their constitutionally protected right to peaceably assemble by the Charlottesville government and only through an injunction issued by District Court Judge, Glen Cochran, were the people opposing the removal of the statue allowed to protest and exercise their constitutionally protected rights? The left initiated violence, the police called the assembly “illegal”, withdrew and allowed the violence to escalate. The political correctness movement lead to violence once again.

Political correctness is behind the removal of these confederate statues also.  In my latest article, Civil War Truths, I expose the lie that the War for Southern Independence, a.k.a. The Civil War, was about slavery. It was about economic subjugation by the North. Yet the false narrative of slavery leads to labeling anyone who wants to protect southern heritage and the truth as white “supremacists”, “nationalists”  or the overused term “racists”. This is just more opposition to free speech under the guise of political correctness and a denial of the truth.

Our government continues to bankrupt our nation via the unconstitutional Federal Reserve and illegal expenditures. They continue to support unlawful aggression across the globe under the guise of American safety and being the world’s policeman. Our children continue to be indoctrinated with socialist dogma in our schools. Our federal government completely ignores the law of the land and issues edict after edict under the facade of the Constitution and “helping” Americans. Our government continues to redesign society through its detrimental immigration policies, and on all levels continues to grow and raises taxes to confiscatory levels to pay for that growth. We are traveling down the road to the destruction of our republic and the gift of liberty given to us by previous generations. The only thing that concerns most are trivial matters. It is no wonder our liberties are being trampled and our country transforming into a socialist atrocity.

Make no mistake – without drastic changes to our path, we will see a bloody revolution in our near future. Americans who understand liberty, unalienable rights and the Constitution will only remain peaceful for so long. I do not advocate for violence as a solution, but I see no other alternative if the tenets of political correctness are our guides in this country while the traditional values, laws and ideals are scrapped. We were bequeathed the most precious gift one generation can give to another – liberty. Americans used to understand this. Now many Americans only understand the idea of political correctness and not offending anyone. The lessons we have learned as Americans are disappearing and are being replaced by socialist teachings. Government is the problem. They are not the solution. If Americans continue to be diverted by the inconsequential then we will continue our slide into mediocrity and irrelevance. Patriots, Awake!

Why Is The Constitution Ignored?

Why is it that so many Americans have turned their back on the Constitution of the United States?

The clear and simple meaning of the Constitution has been allowed to be perverted or simply ignored, and there is no national conversation about it. The majority of stories in the media totally ignore the existence of the Constitution and some in Congress who, when asked about the constitutionality of a bill, scoff at the idea. Very few people, if any, call either out on their behavior.

The Constitution of the United States is the supreme law of the land, yet it has been relegated to the back bench by too many Americans. This needs to change if we are to maintain our status as a free nation.

Congress is the only entity in our federal government that is allowed to make laws. That is confirmed by the first sentence of the Constitution. It is very clear what powers were delegated to Congress.  Article 1 Section 8 details these enumerated powers. These were powers the states originally possessed but were delegated to our newly created federal because it was determined a central authority could better do the job. These powers were described by James Madison, the “father” of the Constitution, in Federalist 45:

“The powers delegated by the proposed Constitution to the federal government, are few and defined. Those which are to remain in the State governments are numerous and indefinite. The former will be exercised principally on external objects, as war, peace, negotiation, and foreign commerce; with which last the power of taxation will, for the most part, be connected. The powers reserved to the several States will extend to all the objects which, in the ordinary course of affairs, concern the lives, liberties, and properties of the people, and the internal order, improvement, and prosperity of the State.”

This is the list of enumerated powers delegated by Article 1 Section 8:

“The  Congress  shall  have  Power  to  lay  and collect  Taxes,  Duties,  Imposts  and  Excises,  to  pay  the  Debts  and provide for the common Defence and general Welfare of the United States;  but  all  Duties,  Imposts  and  Excises  shall  be  uniform throughout the United States;
To borrow Money on the credit of the United States;
To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes;
To establish a uniform Rule of Naturalization, and uniform Laws on the subject of Bankruptcies throughout the United States;
To coin Money, regulate the Value thereof, and of foreign Coin, and fix the Standard of Weights and Measures;
To provide for the Punishment of counterfeiting the Securities and current Coin of the United States;
To establish Post Offices and post Roads;
To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries;
To constitute Tribunals inferior to the supreme Court;
To define and punish Piracies and Felonies committed on the high Seas, and Offences against the Law of Nations;
To  declare  War,  grant  Letters  of  Marque  and  Reprisal,  and  make Rules concerning Captures on Land and Water;
To raise and support Armies, but no Appropriation of Money to that Use shall be for a longer Term than two Years;
To provide and maintain a Navy;
To make Rules for the Government and Regulation of the land and naval Forces;
To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions;
To provide for organizing, arming, and disciplining, the Militia, and for governing such Part of them as may be employed in the Service of  the  United  States,  reserving  to  the  States  respectively,  the
Appointment  of  the  Officers, and the Authority of training the Militia according to the discipline prescribed by Congress;
To exercise exclusive Legislation in all Cases whatsoever, over such District  (not  exceeding  ten  Miles  square)  as  may, by Cession of particular States, and the Acceptance of Congress, become the Seat of  the  Government  of  the  United  States,  and  to  exercise  like Authority   over   all   Places purchased  by the Consent of the Legislature of the State in which the Same shall be, for the Erection of Forts,  Magazines,  Arsenals,  dockYards, and other needful Buildings;—And
To make all Laws which shall be necessary and proper for carrying into  Execution  the  foregoing  Powers,  and  all other  Powers  vested by this Constitution in the Government of the United States, or in any Department or Officer thereof”

These are the only laws which Congress is allowed to administer. 

What is missing from above?  Education. Drug regulations. Environmental laws. Business regulations. Social Security. Automobile regulations. Food regulations. Healthcare.

Add to these enterprises the agencies that have been created illegally in our federal government. Who needs Congress when you have the EPA? Or BLM? Or the FDA? The FCC? Or ATF? OSHA? FDIC? The USDA? Homeland Security? The Department of Labor? The Department of Education? The Department of  Energy?

Those are just a few of the hundreds of agencies and departments that rule our lives and are not authorized by the Constitution.  None of these items and many more tasks the government performs is not authorized by the Constitution and are thus, by definition, unconstitutional.

Add to this argument the simple statement of the 10th Amendment:

“The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

Why is it that we have no stories which address this problem? Nary a peep is heard when we send troops to a foreign country without a declaration of war or Congress makes a “law” concerning healthcare. Both happen too frequently, yet the dialogue we see does not ever question the legality of these actions.

Government officials break the law almost every day, yet no one is called out for their conduct. Our representatives in government take an oath to uphold and defend the Constitution, but no one is held to that oath. Why aren’t we the people talking about this?

It is my goal to educate people on the relevance and meaning of the Constitution of the United States of America. It is not a hard document to understand and contains the solutions to many problems we face today as a nation. Education is the cornerstone of liberty and must occur for us to once again put our country on the trajectory that has made us the most prosperous and free nation the world has ever seen.  Otherwise, we will be relegated to the scrap heap of history and join other failed nations in the gutter of historical mediocrity. We owe it to the billions of people yet to be born to pass on the gift of liberty that was bequeathed to us. Support the Constitution. Support America. Support Liberty.

The Pulse Tragedy : Why it Can Happen Again

It is the anniversary of the killing of 49 people in the Pulse night club. It was a horrendous event that sparked national outrage and a nonsensical response by our local leaders. The problem is that nothing has changed to prevent or minimize the chances of this happening again. Prayer vigils, special flags nor proclamations by city or state leaders do anything to address the problems which allowed this tragedy to unfold the way it did. This has become about the victims and ignores the reality that nothing has been done to empower citizens to prevent a similar tragedy from happening.

Some truths that need to be known.

The police are not tasked with protecting your life.  There have been over 10 cases brought against police where the Supreme Court and lesser courts have determined the police are not responsible for your life if you are murdered. Police in the Pulse incident did not enter the club for almost 3 hours after the shooting began. I do NOT fault police with their actions. It is not their job to protect individual lives. They contained the situation and proceeded when a plan was finally implemented.  Bottom line: you, and only you,  are responsible for your own life.

We have laws on the books here in Florida which state it is illegal for anyone to carry a gun into a bar. I understand the “thinking” behind the law but it left law abiding citizens at the mercy of a deranged killer. The idea that officials at the state level have violated their oath to office is repugnant and should be a crime.  I must have missed the part of the 2nd Amendment which excluded our right to protect ourselves when we enter a bar. Our representatives violated their oaths to office by infringing on the right of people to keep and bear arms and are culpable. There could indeed be problems for drunk patrons that are armed when in a bar.  But as the tragedy of Pulse and other mass shootings are looked into, it becomes apparent that gun free zones are hunting areas for the deranged. I guarantee you that those victims in Pulse would have armed themselves if they had been given the chance, but they were prohibited from doing so by our ignorant and outdated laws. I, like Thomas Jefferson, prefer dangerous liberty to peaceful slavery. Most people when faced with reality agree.

The response by our leaders is also telling.

Buddy Dyer, in his reply to a petition to enact gun control regulations here in Orlando, diverted the conversation by saying only lawmakers in Tallahassee can make those decisions. He is correct but instead of affirming the truth about people’s responsibility for protecting their own lives, he dodges the question and ignores the reality of the situation. I am unaware of any legislation or initiatives which have been implemented to allow people to better protect themselves from madmen like Omar. Silence is consent Buddy. Why do agree that disarmed people are a good idea? Buddy Dyer’s continued ignorance of reality is disturbing. Buddy Dyer did declare June 12th as Orlando United Day. That is the best he has I guess.

Rep. Carlos Guillermo-Smith and Sen. Linda Stewart early in 2017 filed a bill to ban “assault” weapons here in Florida in response to this tragedy. This is a typical knee jerk reaction by the anti-Constitution radical left and nothing new. They “spoke of the need to prevent another massacre like the one at the Pulse nightclub”. Newsflash- these tragedies are hard to prevent, if not impossible. Lone wolf attacks are very hard to detect and stop. There solution was to disarm law abiding citizens which would have NO effect on what happened inside of Pulse that night. None. They used the tragedy to further their own ignorant agenda. Criminals are criminals because they don’t obey the law. Linda Stewart further stated that “But it is also worth mentioning that the people killed by gun violence every day have rights too” yet she violated HER oath to office and tries to restrict those rights by banning “assault” weapons. Typical extremist hypocrisy.

Let’s not forget the politically correctness exhibited by federal authorities in this situation. All references that the gunman made to being aligned with ISIS were censored. In the partial transcripts that were released by authorities, any references Omar Mateen made about his ties or allegiance to ISIS were scrubbed. After MUCH public pressure the transcripts were finally released in their entirety. Political correctness and a twisted agenda seem more important to the authorities than reporting the truth. Public safety is a campaign slogan not reality here in Orlando it seems. Time for people to wake up.

In conclusion, nothing has been done that would minimize another attack like the one that occurred in the Pulse nightclub. We mourn the dead, have street rallies and hoist special flags for them but we have done nothing to address the problem that still exists. We owe it to the 49 dead and those of us still alive to allow people to be able to protect themselves. Protecting ones life is a natural right. the most important we have. That is where the right to keep and bear arms is derived.  Police are not responsible for protecting your life and our representatives keep law abiding citizens from doing it themselves. This is insanity. We remain sitting ducks in gun free zones. Idiocy and political correctness reign.

 

Nullification: A True Liberty Activity

Libertarians in Florida (and in general) need to start addressing issues that are relevant today instead of spouting off about fantasy “solutions”. Talking today about anarchy or open borders does not resonate nor is it a true path toward liberty. Both ideas represent a refusal to deal with real world problems. Neither is a solution to what faces America.

One of the topics we should be talking about is fighting unconstitutional federal laws that affect us in the state of Florida (or any other state you may reside in). This is a problem of “right now” and needs to be solved. Fortunately for us we don’t have to reinvent the wheel. This idea has already been thought about and a solution has been formulated. This is an enumerated principle of Libertarians here in Florida and is a very powerful tool to counter unconstitutional edicts, mandates or “laws” issuing from Washington DC. The process is a simple one to understand and extremely effective in its execution. The simplicity of it is what makes it so elegant.

It is called nullification. It is the idea that a state decides that the federal government is operating outside of it constitutional bounds and is infringing on the rights of its citizens. Its action is to declare the law unconstitutional, the reasons for determining this and stating that no one who works for the state or within the state may aid or in any way help this unlawful expression of power originating from Washington DC. It is an idea espoused by Thomas Jefferson and James Madison. It is the constitutionally tried and true method to fight unconstitutional tyranny issuing from Washington DC.

Before you scoff and say this can never happen realize it has happened multiple times throughout our history and is currently being revived throughout our United States. Look to Washington and Colorado. How long ago did they nullify unconstitutional federal marijuana laws and say the law shall not be enforced within their state limits? Realize, neither stated that they wanted to nor have they tried to change the federal law. What they have done is affirmed that the federal “law” is unconstitutional and not to be enforced within their borders. State agencies and law enforcement are disallowed in aiding or initiating any actions against those people who grow or sell marijuana. The state is to do NOTHING!!! How Libertarian is THAT?! You fight no one. You see unlawful aggression and say that you will not support nor participate in the activity. Without the manpower and logistic support it is almost impossible for the feds to do anything within a state. This is the power of doing nothing.

Another current trend that is not being reported or being under-reported is the “Right to Try” laws. Thirty one states to date have passed laws nullifying unconstitutional mandates of the FDA concerning human “experimentation”.  These laws allow terminally ill patients to purchase drugs that are not currently approved by the FDA. Imagine that? People who are dying have a chance to save their lives in opposition to unconstitutional laws coming out of Washington DC. Imagine also why this is not widely reported on? Imagine if the people figured out they could actually make decisions for them selves and not rely on Washington DC? Things could change for the better and some in charge would not like that.

Other additions to the modern day nullification movement involve constitutional carry. Twelve states where there is no requirements for people to obtain any type of license to carry a gun. Some states and municipalities have nullified ALPR’s (Automatic License Plate Readers) within their bounds of their jurisdictions. This interposition is of varying degrees of restrictions on their collections. Many states have taken up or passed legislation restricting the monitoring and collection of cell phone data within their states via Stingray technology.

I leave hemp for last because it is a special topic for Floridians. Six states have nullified unconstitutional federal laws in their states and now grow hemp legally. Hemp is a wonder crop that has a multitude of uses and is a great crop to rotate to replenish soil. For those who are concerned about misuse, the THC content of hemp is negligible. The use of it as a drug would not be viable. But it IS very useful for many things and is the stuff that prosperity is built upon. Growing a plant that can make rope, canvas, food, drinks, paper, fabric, clothing, building supplies ( including hemp blocks to build houses), and plastics only makes sense. Hemp is the top plant for producing the most cellulose biomass per acre which makes farmers the most money per acre. This biomass is what paper, plastics and textiles are made of. No chemicals or insecticides are needed . All of this from growing this prolific and easy to grow crop. It is not legal in Florida but the industry would thrive here in the state. Because of our weather hemp could be grown year around and be among if not define the highest cultivation rates in the United States. The industries that would be created around this production would create real business and prosperity for Floridians.  We don’t do this because the federal government says it is illegal and the people in Tallahassee have big donor support who like things the way they are. They do not want to fight. That’s where Libertarians get involved.

So you see that nullification is trending and is definitely a force for liberty. Recognize this is a universal principle that will attract many people. . Republicans, Democrats, Independents, Libertarians, Constitutionalists all would agree that determining our own path is a good thing. We will not agree once we have the power what we want to do but at least we the people of Florida decide how we want to live. That is how our country is supposed to work. Washington DC was never supposed to be tinkering with the inner workings of a state. Their focus was to be a representative of the states for the rest of the world and to make sure the states played fair with each other. The primary function of our Federal Government is to secure our rights. Patents and trademarks, weights and measures, coining money, Post offices, postal roads, raising a Navy and Army, conducting war, protecting us from invasion and guaranteeing a republican form of government round out the majority of their enumerated tasks . The rest was left up to the states and the people. Article 1 Section 8 of the Constitution describes exactly Congress’ tasks. How far away from this ideal have we wandered? That is what we fight today to realize liberty tomorrow.

It is my hope that Libertarians can coalesce and figure out as a group how to present their message to the public so we can be a viable force for liberty. The portrayal of libertarians to date has been abysmal and it is up to us to change that. The powers that be like the status quo- i.e. republicans and democrats being the only viable options. Getting behind and promoting an idea such as nullification is a short term and long term winner for libertarians. The true beauty is it is already part of our principles here in Florida. All we need are representatives and candidates who will espouse this policy. Time to get busy.

Charter Amendment 2 : Just say NO Orange County

We are about to do a bad thing here in Orange County. We have those that have proposed that we the people begin to give up control over the Sheriff of our County by allowing his free constitutional status to be abrogated by making them a charter officer.

The proposed Charter Amendment

Changing County Constitutional Officers to Charter
Officers and Providing for Nonpartisan Elections and
Term Limits Amending the Orange County Charter to make the
Sheriff, Tax Collector, Property Appraiser, Supervisor of
Elections, Clerk of Circuit Court, and Comptroller into
nonpartisan, elected charter officers subject to term limits
of four consecutive 4-year terms, abolishing their status
as constitutional officers, and specifying they are not
subject to county commission or mayoral authority and
shall have all rights and privileges of corresponding
constitutional officers, except as expressly provided by
charter. No financial impact.

No financial impact. Plenty of impact as to the direction of government here in Orange County. I will discuss the position of Sheriff and why it is bad to take away his constitutional status. As you read, you can see how bringing the Tax collector, Property Appraiser, Supervisor of Elections, Clerk of the County Court and especially Comptroller who dispenses all of the monies for county activities under one big umbrella consolidates power which is not good for the citizens of Orange County. I will focus on the Sheriff because that position is the most important to protecting our rights here in Orange County.

Please understand that the idea of a Sheriff is a very old idea. Once is was a tool of oppression but when it came under the control of the people it became a force for good. The direction that is being advocated with this charter amendment is detrimental to the long term security and freedom we enjoy as Floridians living in Orange County. The Sheriff is elected and works directly for the people. He is the highest law of the county. He answers directly to the people. We need to keep it that way.

The history of the Sheriff is many centuries old. The first written record of the Sheriff dates back to the reign of King Alfred in the 9th century. The King restructured the kingdom into “shires” and appointed “reeves” to administer his will on his subjects. These shire reeves eventually became to be known as the Sheriff.

It is interesting to note that when King John of England was forced to sign the Magna Carta in 1215, the document which introduced many concepts that were incorporated into the United States Constitution over 500 years later, that the “Sheriff” is mentioned 27 times (out of 63 clauses) in the document, and the powers of the crown to use him against the people was curtailed and defined.

When the idea of the Sheriff was brought to our shores in America, it was a lot closer to today’s idea of the Sheriff. Gone was the allegiance to the power of the state (or monarchy) but instead the allegiance was to the people who elected them. Thomas Jefferson described a Sheriff as ” the most important executive offices of the country”. High praise from a respected man.

The Sheriff in no uncertain terms is the highest law enforcement authority in his/her county. The Sheriff is elected by the people and charged to uphold and defend the Constitution of the United States and that of their own state. That is their duty and they are responsible directly to the people to perform that duty. The are the law of the county.

The Sheriff’s responsibility is to protect the constitutional rights of its citizens from wherever that encroachment occurs. Most people rightly attribute crime fighting to the Sheriff. That is a major responsibility. But the Sheriff’s responsibility does not end there. If ever a citizen of a county has their constitutional rights violated by any representative of the government, the first line of defense to this intrusion if the Sheriff. If an arrest is to be made in a county, the Sheriff has the right to be informed before the arrest is made in his/her county. The Sheriff should determine that the arrest is proper, and was properly adjudicated through the courts. Our federal government is having a much higher tendency to skip due process and render judgements which are unconstitutional.

In New Mexico, Sheriff Scott London of Eddy County notified the IRS that the sale of county resident Kent Carter’s property was canceled until he received due process of law and his appeal was heard. Yes, he successfully told the IRS “no”! Sheriff Richard Mack of  Graham County Arizona was instrumental in the ruling Printz vs. United States in which parts of the Brady Bill were ruled unconstitutional. In Indiana, a farmer who produced raw milk was harassed by the FDA. They conducted warrantless searches of his property and even subpoenaed him to produce production records until Sheriff Brad Rogers interposed after inspecting the farm. He wrote the FDA a letter that stated they needed a signed court order and to get his permission before they visited the farm again. After that, a court date was cancelled and the farmer received no more inspections by the FDA. These are just a few cases that the Sheriff was involved in upholding their constituent’s rights.

The proposal to the Charter will be represented as a term limits amendment. The idea that moving the officers under a charter will be downplayed. “Nothing will change” they will say. “This will make the offices more accountable” they will say. It is true not much would change initially. But this move has a purpose. The charter can be changed and the roles of these officers circumscribed however the charter dictates. This is a move for future mischief. We the people directly control these offices. That is a check and balance built into our system. Don’t destroy another protection of the people by allowing this to pass.

Think of it like this. Do we want to move toward a Sheriff of Nottingham which performed the wishes of the Crown and oppressed the people or Sheriff Mack who successfully fought the government to protect the rights of his constituents? We can stop it easily by voting no on Charter Amendment 2.

Don’t fall for the gimmicks. Vote NO on Charter Amendment 2. Say no to big government control now and for the future.

The Constitution IS America

THE reason that we have had the most prosperous and free country to ever grace the face of the earth is because of our Constitution. It was a revolutionary document which allowed the people to rule themselves by creating a federal government of specific enumerated powers. It formalized a way for government to be replaced regularly without the use of violence. Many others living outside of America when the Constitution was ratified had running bets as to how long the republic would last. We beat the odds and became the beacon of freedom for the world. The Constitution literally created The United States of America.

When we turn our backs on the Constitution we turn our backs on our country. If we allow the Constitution to be attacked we allow America to be degraded. We have a wildly out of control federal government that ignores the laws with impunity and tells us everything is all right. We the people have become complacent and through ignorance have allowed our creation to be our ruler. Government is a force. It needs to be constrained. It is much like fire. It can do many good things but left unattended it can harm and kill. Washington DC is out of control and unless we shackle the beast we will witness the dissolution of our country. Yes, it can happen here. We are not immune from the ravages of historical fact.

The ignorance about the “Law of the Land” is agonizing to witness. The Constitution is a relatively short document and can easily be read in under an hour. Most have not done so. It becomes apparent when interacting with them. Understand this: The Constitution is indeed the law of the land. NO local ordinance, federal regulation, executive order, treaty, state law, federal law, opinion or any other utterance by elected officials has superiority to what is written in the Constitution.

If anything coming out of any government is in defiance of the clear and precise language of the Constitution of the United States it is by definition unconstitutional and void of relevance. That includes any branch of the federal government including the Supreme Court.

The Supreme Court does not make law. They issue opinions. They also are humans and make mistakes and have human failings which make them fallible. The Supreme Court was created by the Constitution and to think they are the final arbiters of what is constitutional is another fallacy that needs to be dispelled if we are to remain a free nation. If you think that the Supreme Court is the final arbiter of what is constitutional then you give the federal government unlimited power to do what it wants which is exactly what we have been witnessing. It must end.

Realize that there are enemies to our country who live among us. They are working toward a socialist form of government which is diametrically opposed to freedom and what this country was founded upon. They continually push for bigger and more intrusive government in out lives. They dismiss the Constitution as an outdated document that needs to be rewritten, replaced or just ignored.

What is most unfortunate is that through patriot’s inaction we have allowed a whole generation of Americans to be taught of the faults of this country and none of the grandeur we have accomplished. Our country had been reduced to slavery and oppression in the eyes of many. We have to date lost the battle of education. That must also change for us to survive as a free nation.

George Washington said it best :

A primary object should be the education of our youth in the science of government. In a republic, what species of knowledge can be equally important? And what duty more pressing than communicating it to those who are to be the future guardians of the liberties of the country? ”

No truer words have been spoken and the enemies of our country HAVE learned this lesson. We need to support the truth and educate our children in this truth. We cannot rely on the schools to do this. We need to take this task to heart and act accordingly.

It is up to YOU to do something. No one else is going to do your job for you. I realize the teachings of history. The majority is not who makes changes. Changes come when a minority of the people with a majority of the will demands and makes the change. The rest of the people just follow along. It is unfortunate but it is the truth. I am talking to a small minority of people, probably in the 3% range. We must make the changes needed for our country to survive. Make no mistake, I am talking about our survival here. We are moving toward a precipice that will engulf us in tyranny and end our nation as we know it.

So what can you do? First get educated. Do not rely on others to tell you what is in the Constitution. Read and study it yourself. There are many resources to get this knowledge. KrisAnne Hall is a person that has never lead me astray and a person whose writings and words I highly recommend. Reject the idea that the Constitution is a “living” document or it is irrelevant in our modern times. Those two arguments are easily dispelled by the educated person.

The Constitution is a compact between sovereign states to create a federal government. Compact means contract. This “contract” is still in force and is still as relevant as when it was written. It has a specific meaning and its interpretation is not subject to modern day ideals.”

Use as much original documentation as you can find for this education. The Federalist Papers, historical writings between our founders and the actual document are all you need to be way ahead of most people when it comes to understanding the meaning and relevance of the Constitution. Read about the Constitutional Convention in Philadelphia. Madison, Jefferson, Hamilton, Jay. Martin, Henry, Adams, Washington, and others of the era depict exactly what our Constitution is all about. I say use original documents because there is plenty out there which is written on the subject and is not accurate of the true meaning of the Constitution. Most Americans have been lied to about what is contained in our founding document. Education is the cornerstone of liberty.

When you do get educated spread the truth far and wide. Liberty lives in the hearts of man and can be rekindled by support of the idea. Speak boldly. Speak the truth. Inspire others to do the same. As things get worse in our country more people start questioning the status quo and want answers. Be able to give them the correct answers. This will lead to a better understanding of the principles this country was founded upon and lead to better results in all things. With a proper education we can identify the true problems in this country and take effective action to combat those problems. Candidates who understand the Constitution will gain more support and we can start to populate our local and state governments with patriots and statesmen once again. The conversation of the day will once more turn to politics and through this dialogue we will find liberty.

Understand what is at stake. We have been left the most precious present ever to be bequeathed to a people-liberty. It was  gained by the blood and suffering of many before us and are obligated to pass that down to future generations. Our country was a true miracle in its birth. So many things were against us yet we pushed through them and became a nation. Miracles do not happen with regularity. That is why they are a miracle. Do not forsake that miracle because you depended on someone else to do the work. YOU are part of the solution. Not anyone else. Do not doom our children and countless millions of others to follow to have to fight and die once again for something that we let slip away.

We Hold These Truths

Contrary to popular belief, the Bill of Rights does NOT give us any rights. Our rights do not come from government. Our rights are not given to us by our fellow man. Our rights come from our Creator. This was a founding principle of our country and seems to have been forgotten by many.

“We hold these truths to be self evident, that all men are created equal, that they are endowed by their CREATOR with certain INALIENABLE rights……”

This was one of the revolutionary ideas that have propelled us into a leading role for liberty on this planet.

This is not semantics. This is the basis for many attacks on our rights and must be corrected. Take guns for instance- it is much easier for the gun grabbers to cite our 2nd Amendment rights than to say they want to infringe on our inalienable right to self defense. Instead of saying they want to restrict our God given rights, they take the position that they are merely “interpreting” a 200+ year old statement about guns. Or they say that the founders couldn’t imagine the progress we have made in firearms technology and we need “common sense” gun regulations.

Even more ludicrous is the idea that the rights given to us by the Constitution have limitations and are subject to the interpretations of some politically connected lawyers who wear black robes and sit in a fancy courtroom in Washington DC. All poppycock. The right to self defense is linked to the right to life and your unfettered ability to protect that life. Without that any other right you may possess is moot. Doesn’t matter that you have freedom of speech if you are dead. Goes for any other rights also. That is why the right to life is always listed at the top and why protecting that right is the most important.

So what does the Bill of Rights do? What is its purpose? Pretty much nothing other than to be a sentinel for the people indicating when government has exceeded its authority and is becoming tyrannical. It is a snapshot of some of our inalienable rights that government has NO authority to infringe upon. These rights we recognize have been fought for for over 900 years.

Look up the 1100 Charter of Liberties. The Magna Carte. The Petition of Right of 1628. The Glorious Revolution and the Bill of Rights of 1689. These were all seminal moments in the pursuit of liberty. Our Bill of Rights and the thought that our rights are inalienable didn’t just occur. It was however boldly trumpeted by the colonists when they declared independence and it was codified into our Constitution.

So next time you see someone saying that our 2nd Amendment right to carry guns is being attacked or that our 1st Amendment right to free speech is under assault, just remind them where our rights come from. We used to understand that our rights are inalienable and are not granted by government but are supposed to be protected by government. It boggles the mind to think that this lesson is too hard to understand or if pointed out will be disputed. Get educated. Get active. Liberty is calling and wants to know if you are for or against her. Freedom is not free and is not a spectator sport. It requires action on your part. A piece of paper will not protect your rights. Only true Americans can do that.
